TERMS AND CONDITIONS
Any person (hereinafter referred to as ”you”) using the services provided by www.plentyofmishief.com (hereinafter referred to as “we”, “us”, “our” or “the site”) is bound to act in compliance with the content of the Terms and Conditions Agreement stated below. Whether a registered user or not you are obliged to take all the Terms and Conditions into consideration while using any of the services of the site and/or viewing its content. Please read the present section carefully. We reserve the right to make amendments in the Terms and Conditions Agreement at any time and advise you to check the section regularly so as to be aware of the occurrence of such.
1. Eligibility. You must be eighteen or over (twenty one years old where this is the age of discretion) to register as a member of or use the site. 2. Membership Account/Termination. We shall reserve the right to terminate your membership account at any time for no reason, the termination will be effective upon sending you notification via e-mail to the e-mail address you provided in your application for membership or any alternative email address you may have supplied at a later stage. Your membership account will be automatically terminated on occasion of you being blocked at least five times by other users.
3. Non Commercial Use by Members. The Site is intended for the personal use of individual Members only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not become Members and shall not use the site for any purpose whatsoever. Illegal and/or unauthorized uses of the Website, including collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Website will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.
4. Proprietary Rights over Content on Plenty of Mischief. We own and retain all proprietary rights in the site and the brand name Plenty of Mischief. The site contains the copyrighted material, trademarks, and other proprietary information of Plenty of Mischief, and its licensors. Except for that information which is in the public domain or for which you have been given explicit written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
5. Content Posted on the Site and Use of Content Posted on the Site. You are solely responsible for any content you post on the site and though the restrictions we pose on your activity (points 5.1 - 5.6 below) in relation to this are to be regarded as not covering the full scope of rules we insist on, they are elaborate enough to provide you with a clear understanding of what we consider a proper user`s attitude towards the site and services of Plenty of Mischief. “Posting” is herein used as an action that may be expressed by one or all of the activities of: sending electronic mail, uploading, otherwise making available.
5.1. We are not to be held responsible and remain to the fullest extend exempt from liability under the law and as provided under the Communications Decency Act for content provided by third parties and members and nothing in this agreement is intended to waive, remove, or usurp such immunity.
5.2. You will refrain from posting on the site and/or transmitting to other members any sort of content (namely but not only: texts, messages, pictures, photos, profiles, graphics) that is in itself blatantly abusive and/or offensive to the online community because of its nature being of the kind to incite illegal activity such as: racism, bigotry, incest, hatred or physical harm of any kind against any group or individual as well as conduct that is abusive, threatening, obscene, defamatory or libelous. A full self-contained list of all prohibited material is not what we intend to create for the means of the current section, but we nevertheless aim at stating a large number of possible infringements and the following shall also be considered as such: transmission of "junk mail", "chain letters," or unsolicited commercial e-mail or "spamming"; promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files; contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page); displays pornographic or sexually explicit material of any kind; provides material that exploits people under the age of 18 (or 21 in countries where this is the legal age) in a sexual or violent manner, or solicits personal information from anyone under 18 (or 21 in countries where this is the legal age); provides content that involves cursing, swearing, incest, falsifying gender, violence, necrophilia, impersonating another member, threat of suicide or harm to oneself or others, drug paraphernalia, or bestiality; provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses; solicits passwords or personal identifying information for commercial or unlawful purposes from other users; sending advertisements in chat or instant messaging messages; and engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising and pyramid schemes.
5.3. You will at all times use the site and services provided by Plenty of Mischief in a manner consistent with all applicable laws and regulations for your country.
5.4. We shall take into consideration our judgment only when deciding to delete from the site any content posted by you that we deem is offensive, illegal, or that might violate the rights, harm, or threaten the safety of Plenty of Mischief and/or its members
5.5. You will not interfere with or disrupt servers or networks connected to the site, or disobey any requirements, procedures, policies or regulations of networks connected to the site.
5.6. You will not transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment
5.7. By posting content to any public area of Plenty of Mischief, you automatically grant, and you represent and warrant that you have the right to grant us and our members with an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display, and distribute such information, rights of publicity, and content and to prepare derivative works of, or incorporate into other works and other media, such information and content, and to grant and authorize sublicenses of the foregoing.
6. Disclaimers. The site and the service are provided on an "AS-IS" basis and we expressly disclaim any warranty of fitness for a particular purpose or non-infringement. We do not guarantee you any particular results and/or specifics you might be expecting to find through your use of the site. We can not promise to meet your requirements or fulfill expectations you may have of our site and services. We are not responsible for any incorrect or inaccurate content posted on the site or in, whether caused by users, members or by any of the equipment or programming associated with or utilised in the service, nor for the conduct of any user and/or member of the service whether online or offline. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user and/or member communications. We are, under no circumstances, be held responsible for any loss or damage resulting from anyone's use of the site or the service and/or any content posted on the site or transmitted to members.
7. Games and Contests. We are intent on providing a good quality service to users and it is our firm belief that all contests and games Plenty of Mischief sets forth are to be regarded as such. We shall be the ones to design the rules for participation and we are the only authority to make a decision on the winners. We advise you to check this section from time to time and acquaint yourself with all contemporary games and contests now playing on the site.
You should mark the following notice: a particular user is to win an I-pod once only for a sixth month period.
8. Dealings With Advertisers.Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Plenty of Mischief shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the site.
9. Limitation on Liability. Except in jurisdictions where such provisions are restricted, in no event will we be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the site or the ervice, even if we have been advised of the possibility of such damages.
10 . Indemnity. You agree to indemnify and hold Plenty of Mischief, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the service in violation of this Agreement and/or arising from a breach of these Terms and Conditions and/or any breach of your representations and warranties set forth above.
11. iPhone Terms

11. iPhone Terms
- All parties entering the IPhone contest must be 18 and over.
- You will be asked to prove upon winning the competition that the photo is original and not fake with official Identification.
- If the IPhone is not available in your country of origin at the time of winning the competition we will issue you a cheque for the value of an IPhone at contract price minus the line rental fees.
- The prize is for an IPhone and not the attached line rental.
- Competition for an IPhone is issued once every 4 months and the same winner cannot win an IPhone more than once in a given year.
